We offer the Website, including all information, tools, and services available from the Website to you, the user, conditioned upon your acceptance of all terms and conditions stated in our Terms and Conditions. By accessing, using, subscribing, or placing an order over the Website, you and your business (including any sub users you may have) agree to the terms and conditions set forth herein.

Our Products and Published Material

First Light Flower Essences of New Zealand®

The First Light Flower Essences of New Zealand® system and structure of 185 essences made using a proprietary process are the intellectual property of Franchelle Ofsoské-Wyber, and are protected by copyright. The system and structure with its associated descriptions using flower essence names is the sole property of Franchelle Ofsoské-Wyber. The keywords, archetypes and descriptors used to define the First Light Flower Essences of New Zealand® system and structure of 185 essences made from native New Zealand plants and flowers are the intellectual property of Franchelle Ofsoské-Wyber.

You can use this system and structure with its associated 10ml stock essences to create 20-25ml First Light Flower Essences of New Zealand® flower essence blends for personal use by yourself, your friends and family or your clients after a consultation with you. When making a 20-25ml First Light Flower Essences of New Zealand® flower essence blend a First Light Flower Essences of New Zealand® blank label is to be used on the bottle or the label on the flower essence bottle should include the following statement: “Flower essences supplied by First Light Flower Essences of New Zealand® – all rights reserved”.

The First Light® College of New Zealand Native Flower Essence educational and teaching structures and models, including, but not limited to, First Light® Medicine Wheel©, First Light® Nature’s Holistic Healing Matrix©, First Light® Advanced Holistic Healing Matrix©, First Light® Healing Chord©, First Light® Nature’s Holistic Healing Triad© are intellectual property of Franchelle Ofsoské-Wyber, and are protected by copyright.

Programs, Course Material, Lessons, Books, eBooks and Other Material

Some website content, the First Light® College of New Zealand Native Flower Essence Therapy online programs, courses, books and workbooks – including all text, original images, graphics, art work, photographs, design elements, and educational models, etc, is the intellectual property of Franchelle Ofsoské-Wyber.

All course materials delivered in written, video or audio form, books, brochures, ebooks and other material published in hard or soft copy by us and its associated brands, websites and online schools are the sole copyright of Franchelle Ofsoské-Wyber.

No part of the course materials, books, brochures, ebooks may be reproduced, stored in a retrieval system, taught or transmitted in any form or by any means in person or online without the prior permission in writing from Franchelle Ofsoské-Wyber.

Under no circumstances whatsoever may these course materials, books, brochures, ebooks be used as part of any other educational or study program or made available to the general public unless permission to do so has been received in writing from Franchelle Ofsoské-Wyber. Nor can this material be otherwise circulated in any form of binding or cover other than that in which it is published in hard or soft copy.

All course materials, supplied by us are for the exclusive use of the enrolled student and may not be photocopied, transmitted, used or disposed of to any third party without the written permission from Franchelle Ofsoské-Wyber. A maximum of 25 words may be used for review and endorsement purposes and its source must be cited.

Using and Selling our Products

Unless a formal agreement has been entered into with us, we are not a supplier of raw materials or ingredients for you to manufacture your own commercially branded products or ranges of products.

Cloning or using our intellectual property or copyright material and without our written permission in the making, marketing and selling of your own commercially branded products or ranges of products will be seen as an infringement of our intellectual property and copyright.

All of our products are our intellectual property and as a matter of policy we do pursue any unauthorised use.

The resale, redistribution, or commercial exploitation of any of our products — including but not limited to the resale of products via third-party websites, online marketplaces, social media platforms, or retail outlets — is strictly prohibited without our prior written authorisation.

We do not permit any individual or business to sell our products at retail, wholesale, or at any price point without explicit written consent from us. Any unauthorised resale may result in immediate suspension or termination of supply and may be subject to legal action.

All product images, descriptions, branding, trademarks, and other content displayed on our website or marketing materials remain under intellectual property. The unauthorised use, reproduction, modification, or distribution of our images or content — including use on third-party websites or sales platforms — is strictly prohibited without prior written permission.

First Light Flower Essences of New Zealand® and First Light Natural Health® products are created by Franchelle Ofsoské-Wyber and are part of in-class and online study educational programs owned by Franchelle Ofsoské-Wyber. These products are used as part of copyrighted in-class and online study educational programs that have been created and made publicly available by us. Under no circumstances whatsoever may they be used as part of any other educational or study program made available to the general public unless permission to do so has been received in writing.

Using our Published Material

All material in written, video or audio form is protected under copyright law.

You must follow the terms outlined below when using or reproducing any material published in written, video or audio form, including but not limited to websites, courses, books, ebooks, brochures, newsletters, social media posts by us and its associated brands, websites and online schools for your own use:

When quoting, using or reproducing any material for review and endorsement purposes that is over 25 words long, permission must be obtained in writing from Franchelle Ofsoské-Wyber via email. You will be required to submit a sample of what the material is to be used for via email to Franchelle Ofsoské-Wyber prior to the material circulating. If you require specific images or text from us please email your request with full details of what you require and your intended purpose and uses thereof.

Using our Logos and Trademarks

Under no circumstances may any logo be used without obtaining permission in writing from us.

Should permission to use our logo be given, it does not imply company representation, but rather professional association with the company. The logo must be used in a manner and context that accurately represents the brand, its products and services. The brands are trademarks and are copyright with all rights reserved to the owner.

First Light Flower Essences of New Zealand® holds exclusive rights to the trademarks registered under its name. Any time the trademarked name is used it must be accompanied by a ® to denote that it is a registered trademark.

Important Information

Working with People with Highly Specialised Conditions

Working with people with highly specialised conditions such as significant personality, psychiatric or mental health issues may require a highly trained, knowledgeable and specialised approach which is not part of our instructions or the First Light® College of New Zealand Native Flower Essence Therapy training. As a practitioner you are not obliged or required to accept every person who comes to you as a client and you need to know what your limitations are. Each person is advised to operate within the parameters of their individual skillset which is defined by the training that they have successfully undertaken and the knowledge that they have gained.

Third Party Payment Gateway

When you place an order with us you will provide some personal and credit card details to our PCI compliant secure third party payment gateway. No credit card information is stored on our site.

What we collect

Contact and delivery details: your name, email address, phone number, billing and delivery address.
Order details: what you bought, returned or cancelled, and the date of birth and name on the bottle if you order a personalised blend.
Payment details: taken and processed by Shopify Payments. We do not see or store your full card number.
Account details: your username, password and preferences if you create an account or hold a trade account.
Website use: your device, browser, IP address and how you move around the site, collected through cookies and similar technology.
Messages: anything you send us by email, our contact form or social media.

Why we use it

To take payment, pack and deliver your order, and answer your questions.
To run your account, including trade pricing where it applies.
To send you email or SMS marketing where you have asked for it. You can unsubscribe at any time from the link in any message.
To keep the site secure and prevent fraud.
To meet our legal and tax obligations.

Who we share it with

We share only what is needed with the services that run our business: Shopify, which hosts this store and processes payments, our email platform Klaviyo, our couriers and NZ Post so your order can be delivered, our review platform, and our analytics providers. Some of these providers are outside New Zealand, which means your information may be stored overseas.

We do not sell your personal information.

Practitioner listings

Practitioners in our directory appear with their consent. Their name, location, qualification, photograph and the contact details they gave us are published so clients can find them. A practitioner can ask us to change or remove their listing at any time.

How long we keep it

We keep order records for as long as we need them for tax, warranty and accounting purposes, and account details until you ask us to close your account.

Your rights

Under the Privacy Act 2020 you can ask to see the personal information we hold about you and ask us to correct it. Email us and we will respond as soon as we can, and within 20 working days. If you are not satisfied you can contact the Office of the Privacy Commissioner at privacy.org.nz.
